  1. Disclaimer
    All transactions carried out via the Company's cryptocurrency ATMs are irreversible and recorded on the blockchain. Future Breeze s.r.o. (hereinafter: the "Company") is not liable for the funds used in transactions or for the cryptocurrency wallet address provided by the User. It is strictly prohibited to use the devices for any illegal purposes.
  1. Use of Devices (Bitcoin ATMs)
    Initiating a transaction constitutes acceptance of these Terms of Service. The User confirms they have full control over the cryptocurrency wallet and that the funds used originate from a lawful source.
  1. Fraud Risk
    Never send cryptocurrency to unknown individuals. Common fraud schemes include romance scams, fake job offers, investment fraud, and online sales scams. In case of doubt, it is recommended to contact customer support before proceeding with a transaction.
  1. Service Risks
    Cryptocurrencies are not legal tender.
    Their value can fluctuate significantly.
    Blockchain transactions are irreversible.
    Online services are exposed to cyberattacks.
  1. Responsibility for Funds
    The Company does not provide custodial services. After a transaction is completed, the User is solely responsible for securing their assets.
  1. Transaction Limits
    Cash transactions may be subject to single or periodic limits. Circumventing limits by using multiple wallets is prohibited. The Company reserves the right to block or report suspicious transactions.
  1. Fees
    Purchase: margin up to approx. 5.7% above market rate
    Sale: margin up to approx. 4.8% below market rate
    Network fees: based on current blockchain rates
    The total cost of the transaction is displayed before confirmation.
  1. User Eligibility
    The service is available only to adults acting on their own behalf. The Company reserves the right to refuse any transaction without providing a reason.
  1. Data Processing
    Personal data is processed in accordance with the Czech Data Protection Act and the GDPR solely for AML/KYC compliance. Data is stored for up to 10 years and may be disclosed only to authorized authorities.
  1. Common Errors
    – Illegible ID document
    – Selecting the wrong token standard (e.g., BEP-20 instead of ERC-20)
    – Incorrect address entry – using a QR code is recommended
    – Attempted double spend
    Keep your receipt – it will help with any potential complaints.
  1. User Responsibilities
    The User agrees to:
    – provide accurate data and addresses,
    – not use the devices for illegal purposes,
    – not damage the devices,
    – cooperate with the operator if verification is required.
  1. Communication
    Providing contact details (phone number, email) constitutes consent to be contacted. Communications may be recorded. The Company does not guarantee continuous service availability.
  1. Limitation of Liability
    Except in cases of gross negligence or bad faith, the User waives any claims against the Company related to the use of the devices.
  1. Force Majeure
    The Company shall not be held liable for service disruptions due to events beyond its control, such as technical failures, natural disasters, or legal/regulatory changes.
  1. Changes to the Terms
    The Company reserves the right to update these Terms at any time. Continued use of the devices constitutes acceptance of any such changes.
  1. Regulatory Compliance
    The Company operates in accordance with applicable Czech law and EU regulations concerning virtual asset services. Should it become subject to Regulation (EU) 2023/1114 (MiCA), it will fulfil the registration obligation as a CASP in the Czech Republic.
  1. Dispute Resolution
    Complaints may be submitted to the online form. If unresolved within 30 days, disputes may be referred to mediation or arbitration in accordance with Czech law.
